Agency Workers: Working time and holiday entitlements
The government view is that after completion of the qualifying period (thought to be 12 weeks) on a given assignment agency workers should be entitled to the same working time (same hours, night shift pattern, break periods etc) and to be paid the appropriate rate for overtime if overtime payments are made.
Agency workers will also be entitled to the same holiday entitlements as a direct employee.
Payment in lieu may be made but again nobody knows how it will work until the guidance notes are released.
