Agency Workers: Right to Access Onsite Facililities
From the start of a worker's assignment an agency worker has the right to be treated no less favourably than a comparable worker in the hirer's establishment in relation to:
- Canteen or similar facilities
- Child care facilities
- Transport services
This list is not exhaustive and guidance notes will clarify but the the spirit is that the agency worker will have access to equal and not better treatment.
The provision in the draft regulations that less favourable treatment can be achieved "on objective grounds" (whatever that meant) has been removed from the regulations.
It is clear that the regulations are meant to bite and whilst these particular clauses are not that controversial taken in the round it does make the use of traditional temporary workers that much less attractive..
